1. Acceptance of Terms
Welcome to Yeah Nah Wine. These Terms of Use ("Terms") govern your use of the Yeah Nah Wine mobile application (the "App") and related services (collectively, the "Service").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
Yeah Nah Wine is a wine rating application that allows users to:
- Scan wine barcodes using their device camera
- Photograph wine labels to auto-fill wine details
- Record binary ratings (Nah Yeah = good, Yeah Nah = bad) for wines
- Save wines for later rating
- View their personal rating history
- Optionally sign in to sync ratings across devices
- View community ratings from other users
The App is designed for personal, non-commercial use only.
3. User Responsibilities
By using the App, you agree to:
- Use the App only for lawful purposes
- Not attempt to interfere with, compromise, or disable any aspect of the App
- Not use the App to transmit malicious code, viruses, or harmful data
- Not reverse engineer, decompile, or disassemble the App
- Not use the App to collect or harvest information from other users
You are responsible for maintaining the security of your device and for all activities that occur on your device.
4. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- DEFECTS WILL BE CORRECTED
- THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS
- WINE RATINGS WILL BE ACCURATE OR RELIABLE
WINE RATINGS ARE SUBJECTIVE AND BASED ON PERSONAL PREFERENCE. ONE PERSON'S VERDICT MAY DIFFER FROM ANOTHER'S. WE MAKE NO REPRESENTATIONS ABOUT THE QUALITY, ACCURACY, OR RELIABILITY OF USER RATINGS.
5. Limitation of Liability
To the maximum extent permitted by law, Yeah Nah Wine, its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or revenue arising from your use of the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to use the App (if any).
Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so the above limitations may not apply to you.
6. Indemnification
You agree to indemnify, defend, and hold harmless Yeah Nah Wine, its founders, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your use of the App to engage in illegal or fraudulent activity
7. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may delete your account at any time via Settings → Delete Account within the App.
Sections 4 (Disclaimer), 5 (Limitation of Liability), 6 (Indemnification), and 9 (Governing Law) survive termination of these Terms.
8. Intellectual Property
The App, including its design, code, content, and branding, is owned by Yeah Nah Wine and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our prior written consent.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
10. Changes to Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of these Terms.
Your continued use of the App after any changes indicates your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
